Discovering Evidence - Starting on the Right

The way to win lawsuits is to discover evidence early,
forcing your opponent to admit the facts, using the
discovery tools we teach in our tutorials.
If you're a plaintiff:
Begin discovering evidence by alleging in your Complaint all facts you need to prove your causes of action. (See our "Causes of Action" tutorial to learn what
facts you must prove to win.)
No need to allege facts that aren't relevant. That's just
wasting time and telegraphing to the judge that you don't know what you're doing.
Allege all facts that support your causes of action, then stop.
Allege only one fact per numbered
paragraph. Don't make it easy for the other side to deny a paragraph because it says more than one thing ... one true and the other false. Say only one thing in each numbered paragraph. That way, the other side must either deny or
admit the fact. Give him no wiggle room.
Many people lose because they go off on tangents, alleging all sorts of immaterial facts
when only material facts matter. Start early to discover material facts you need to
win.
